Terms of service
These terms apply to your use of sparc.fashion and to everything you buy from us. Please read them before you order. By placing an order you accept these terms.
Nothing here removes your consumer rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have that cannot lawfully be excluded. Where we limit our liability below, that limit applies only so far as the law allows.
Prices and availability
All prices are in Australian dollars and include GST where it applies. Pieces are made to order in limited runs, so a size or colourway can sell out or be withdrawn. We try to keep the site accurate, but if an obvious pricing or description error affects your order we will contact you before making anything and you may cancel for a full refund.
Your order
Placing an order is an offer to buy. A contract is formed when we email you to confirm dispatch, not when you receive an order acknowledgement. If we cannot fulfil an order we will tell you and refund you in full. Payment is taken at checkout through Shopify's payment providers; we never see or store your full card details.
Delivery and returns
Delivery timing and costs are set out in our shipping policy. Your right to return a piece, and how refunds work, are set out in our refund policy. Both form part of these terms.
Using "See it on you", our virtual try-on
The virtual try-on is optional. If you use it:
- Only upload a photograph of yourself, or one you have the clear permission of the person pictured to use. Do not upload a photograph of a child.
- Your photograph is sent to a third-party image service for the sole purpose of creating your try-on, and is deleted as soon as the try-on is made or fails.
- The result is an illustration generated from your photograph. It is not a photograph of the finished garment on your body, and colour, fit and drape do vary in real life. It is a guide, not a representation of the goods.
- You keep ownership of the photograph you upload. You give us permission to use it only to create your try-on, and for nothing else.
- Do not use the feature to create images that are unlawful, obscene, or that impersonate or demean anyone.
If a piece is not what the try-on led you to expect, your 30-day change-of-mind return applies in the usual way.
Your account
If you create an account, keep your password to yourself and tell us promptly if you think someone else has used it. You are responsible for what happens under your account until you do.
Our content
The SPARC name, logo, photography, prints, designs and site content belong to us or our licensors. You may look at them and share links. You may not copy, resell, scrape or use them commercially, or use them to train a machine-learning model, without our written permission.
Acceptable use
Please do not attempt to break, overload or gain unauthorised access to the site, place orders fraudulently, or use the site in a way that breaks the law or interferes with anyone else's use of it.
Liability
Subject always to the consumer guarantees described above, we are not liable for loss that was not reasonably foreseeable, or for loss caused by events outside our reasonable control such as carrier delays, customs, or interruptions to a third-party service. Where we are liable and the law permits a limit, our liability is limited, at our option, to replacing the goods or refunding what you paid for them.

How we handle your personal information is set out in our privacy policy.
Governing law
These terms are governed by the laws of Australia, and the courts of Australia have jurisdiction. If you live elsewhere, you keep the benefit of any mandatory consumer protections of your own country.
Changes
We may update these terms. The version published here when you place an order is the version that applies to that order.
